Use of the www.wine-czech.com web site is on condition that you agree to these terms and conditions and that any future use of the site will renew such agreement. Please read them carefully before making any orders. Nothing in these terms and conditions will affect your statutory rights.
If you are uncertain about these terms and conditions please contact us and ask for an explanation. For further information about your statutory rights contact your local authority Trading Standards Department or Citizen’s Advice Bureau. We may change these terms and conditions at any time. Any changes will take affect when they are posted onto the site and will affect your subsequent orders and purchase.
www.wine-czech.com (hereafter called ‘wine-czech’) is a UK based business with strong Czech connections which enable it to obtain top quality Czech wine for affordable prices. Any disputes or claims arising from the use of this web site must be made and settled under the English law and the exclusive jurisdiction of England and Wales.
When you place an order with wine-czech it is treated as a request. wine-czech has limited stock available which means the wines listed are subject to availability on first come first serve basis. We always try to keep reasonable amount of stock. If you order wine which is not immediately available, we will notify you accordingly and tell you the date of our next shipment due, which is usually within a month. Provided that you are willing to wait, we will then contact you immediately after the date of our next shipment to complete your purchase. If you do not want to wait, you can either withdraw your order or order different wine from our website.
When you place your order on the website and once we have established the stock is available we will contact you usually within 2 but maximum 5 working days and only then we charge you the purchase price plus delivery charge if any (see below). Your payment to us completes your purchase and creates a binding contract between us. From the date of the completion of your purchase you will have 7 days cooling off period within which you can cancel your purchase and demand your money back. We will reimburse all monies for the wine within 15 days from the date you notify us by email of the cancellation. wine-czech reserves the right not to accept any orders.
At the time of purchase we will also agree with you a convenient date and time for delivery. Regardless of the cooling off period the contract cannot be cancelled from and inclusive the delivery date when the goods are being delivered to you other then by exercising your other statutory rights.
wine-czech makes every effort to ensure the information listed on the website is accurate and up-to-date but there are times due to circumstances beyond our control when the vintage or price may change. We will always keep you informed of any changes made to your order prior to your purchase.
While we try to ensure that all prices on our website are accurate, errors may sometimes occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods you will receive a full refund within 15 days but no other compensation.
References to years
Wine is also described by reference to the year of its production. If you order wine produced in a particular year which is no longer available by reason of the supplier exhausting its supplies we will automatically deliver and you agree to accept the wine produced in the subsequent year.
Packaging
The wine bottles are usually packed in the boxes of 6 bottles each but it is possible to mix different wines into one box. You can order any number of bottles without any restrictions.
Minimum order
Minimum order for business is 1 box or 6 bottles. Minimum order for consumers is 2 bottles.
Delivery Charge
Delivery within 10 miles of Aylesbury Bucks. is free. Other delivery charges vary depending on the amounts delivered and distance but as a rule of thumb are charged at 40 pence per mile. We will always agree any delivery charge with you in writing prior to delivery.
Delivery
We will always try to deliver within 5 to 10 working days of your purchase but we usually aim to deliver within 2 working days. wine-czech shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond their control. The date and time of the delivery is not of essence.
Deliveries are usually made Monday to Friday 9.00am to 7.00pm except for bank holidays, but other days and times can be agreed. wine-czech delivers to anywhere in mainland UK. All other areas such as Isle of Wight, The Scottish Highlands, UK Offshore, and the Isle of Man are subject to agreement and additional delivery charges. We do not deliver to Northern Ireland, The Channel Islands or overseas at the moment.
You agree to sign a 'proof of delivery' sheet or electronic notepad. If there is any obvious damage to the content of the package, it needs to be noted on the proof of delivery. No further notifications of damages to packaging will be accepted. All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted or if the delivery cannot be made for any other reason the goods will be retained by the driver, in which case the driver will leave notification of attempted delivery with further instructions. In such case you also agree for the driver to contact you on the mobile telephone number you provided at the time of order/purchase. You will agree to indemnify us in respect of any unsuccessful delivery which remains undelivered on the agreed delivery date due to no fault of our own.
The ownership and title as well as the risk in the goods pass onto you at the time of completed delivery. If the customer gives special instructions for wine-czech to leave the wine outside your house it will be left at your own risk. You must notify us of any breakages which cannot be discovered at the time of the delivery within 24 hours after the delivery by email.
Invoices
wine-czech is registered for VAT. VAT invoices are available upon request. Invoices will be given to you on delivery.
In accordance with UK law when you place an order with wine-czech you warrant that you are at least 18 years of age and that you are legally capable of entering into binding contracts.
Indemnification
You agree to indemnify wine-czech its employees agents and representatives and to hold them harmless from all reasonable damages losses taxes duties fees expenses claims and liabilities including legal fees that may arise from the use of wine-czech.
Warranties
wine-czech warrant that the wines will be of satisfactory quality and fit for general purpose.
Other than as stated elsewhere within these terms and conditions all warranties conditions terms and undertakings expressed or implied whether by statute common law custom trade usage course of dealings or otherwise are hereby excluded to the fullest extent permitted by law. Your consumer statutory rights remain unaffected.
Age Restriction
You must be aged 18 years old to purchase alcohol. By placing an order you confirm you are at least 18 years old. If you are buying the wine as a gift then the recipient must be 18 years old.

Returns and Cancellations
All notifications of returns cancellations complaints and all other communications must in by email at the email address below. All returns by you must be either by recorded delivery or via a reputable UK based delivery company to our address below.
Wine-czech will always try to act to your fullest satisfaction with our products and service. If any of our products fall below reasonable standard and provided you agree to return such wines back to us we will refund your money in full within 15 days of receiving the return. Such return will amount to a cancellation of the contract. If the wines are not returned you will agree and we will arrange collection and the collection costs will be deducted from your refund which will be sent to you within 15 days of our collection.
Wine is a perishable product. It will from time to time be out of condition. This is normally termed as 'corked' wine and occurs in less than one percent of wines consumed. If you are unfortunate enough to find a 'corked' wine within your case please contact us and we will refund the appropriate part of your purchase price provided you agree to return such products back to us at your own costs or allow for collection the costs of which will be deducted form you refund which will be sent to you within 15 days of our collection.
If the product is delivered damaged or the wrong product is sent in error, please contact us we will arrange for a replacement to be dispatched as soon as possible and for the damaged/wrong goods to be collected at our own costs. If that wine is no longer available we will offer an alternative product or give you the opportunity of a refund.
All wines have to be stored in dark cold premises and secure premises until we collect them from you. All bottles subject to return must remain unopened and intact (other than bottles with ‘corked’ wine problem which must be properly and securely closed). Failure to return the wines or make available for collection will amount to breach of contract. We cannot be responsible for any faults of our products caused by improper storage or handling.
You may cancel if you wish your purchase for whatever reason within 7 days of your purchase unless you agree a delivery date within that 7 day period in which case you cannot cancel from and inclusive the delivery date as our performance would have already commenced on that date.
Data Protection
We agree not to pass any of your personal data onto third parties except if we are under legal duty to do so.
